Section 1. The Protection of Democratic Integrity (The Quarter-Millennia Standard).
The United States hereby reaffirms its status as a Representative Republic, a form of democracy that has existed as a pillar of liberty for a quarter-millennia. Any act to dismantle this structural continuity is a crime against the sovereign people.
Section 2. The Crime of Democratic Treason
Democratic Treason is hereby defined as any intentional act by a person holding federal office to subvert, dismantle, or bypass the established constitutional or statutory machinery of the United States for personal, financial, or partisan gain.
- Systemic Subversion: This includes conspiring with foreign or non-state actors to influence federal elections or using “off-book” diplomacy to bypass the Senate’s power of Advice and Consent.
- Structural Obstruction: The intentional destruction or concealment of Sovereign Records, or the use of federal facilities and resources for partisan campaign activity in violation of the Hatch Act.
- The Purse Rule: The conditioning of legally appropriated funds or the “faithful execution” of law upon the performance of a personal or political favor.
Section 3. The Statutory Fence (Executive Privilege)
The doctrine of Executive Privilege is hereby restricted.
- The Transparency Limit: Privilege shall apply strictly to matters of immediate, specific National Security (identifiable risk to human life or technical intelligence assets).
- The Criminal Exception: Executive Privilege is void in any investigation involving the misappropriation of funds, electoral integrity, or the destruction of records. No official may use “National Security” as a shield to conceal evidence of a crime against the Republic.
Section 4. Modern & Legacy Emoluments
No person holding federal office shall receive any financial gain, premium over market value, or business advantage from a foreign or domestic government entity.
- The “Eternal Bribe” Rule: This prohibition extends to Legacy Emoluments—any deferred compensation, consulting fees, or board seats received after leaving office that are linked to actions taken while in power.
- The Forfeiture Rule: Any income, including media profits or digital monetization, derived from the notoriety of a conviction under this Article shall be forfeited to the Treasury under the “Son of Sam” principle of unjust enrichment.
Section 5. Removal of the Immunity Loophole
- Statute of Limitations: There shall be no statute of limitations for the crime of Democratic Treason. Jurisdiction over the offender is perpetual.
- Pardon Restriction: The Presidential power to grant Reprieves and Pardons shall not extend to convictions of Democratic Treason. These crimes are committed against the structure of the Republic itself and cannot be forgiven by the Executive.
Section 6. The Public Truth Mandate
The public is entitled to the full evidentiary record of any investigation into Democratic Treason. All shielded testimony, “Helsinki” notes, and classified evidence must be unsealed and published within 90 days of the end of the subject’s administration or 10 years after the opening of the file, whichever occurs first.
Section 7. The Principle of Representative Service.
The United States hereby rejects the theorem of a Unitary Executive. It is contrary to the spirit of the Republic and is hereby considered an act of Democratic Treason. The President is the highest elected official, not a sovereign. The job of the Executive is to guide the government in a path that aligns with the electorate’s philosophy. It must also remain strictly bound by the representative Republic form of democracy. Any attempt to centralize power to bypass the check-and-balance system is a per se violation of this Article. This holds true regardless of the efficiency claimed.
